Rubbish Removal Holland Park Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Holland Park provides waste collection and rubbish removal services to you. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below.

Customer means the person, business, or organisation booking or receiving the rubbish removal or waste collection service.

Company means the operator of Rubbish Removal Holland Park providing the services described in these Terms and Conditions.

Service or Services means rubbish removal, waste collection, clearance, loading, transportation, and related services supplied by the Company.

Waste means any items, materials, refuse, junk, or rubbish presented for removal under the Service.

Booking means a request made by the Customer and accepted by the Company for the provision of Services at an agreed time, date, and place.

2. Scope of Services

The Company provides rubbish removal and waste collection services within its operational area, including collections from residential and commercial premises. Services may include, but are not limited to, household rubbish removal, bulky waste removal, garden waste removal, and light commercial clearances.

The exact scope of each Service will be confirmed at the time of Booking, including the estimated volume or weight of Waste to be collected, the location of the Waste on the premises, and any special requirements disclosed by the Customer.

The Company reserves the right to decline any collection where it reasonably believes the Waste is not as described at the time of Booking, is unsafe to collect, or breaches applicable waste regulations.

3. Booking Process

Bookings may be made by telephone, email, or through any other contact method made available by the Company. The Customer must provide accurate and complete information regarding the nature, quantity, and location of the Waste to be collected, as well as accurate contact details and access instructions.

At the time of Booking, the Company will provide an estimated price or a pricing structure based on the information supplied. This estimate is subject to confirmation on arrival, following a visual inspection of the Waste.

A Booking is not considered confirmed until the Company has accepted it and provided a confirmation by verbal agreement, email, message, or other written confirmation method. The Company reserves the right to refuse any Booking at its sole discretion.

The Customer is responsible for ensuring that someone with authority to agree to the final price and terms is present at the premises at the time of collection, unless an alternative arrangement has been agreed in advance.

4. Pricing and Quotations

Prices are generally based on the volume, weight, and type of Waste, as well as the labour and time required, access conditions, and any disposal fees or government charges. Prices may also vary depending on the Service area and time of collection.

Any quotation or estimate provided before collection is based on the information supplied by the Customer and is not final or binding if the actual Waste differs in quantity, type, or location from that described at the time of Booking.

Upon arrival, the Company will assess the Waste and confirm the final price before commencing work. If the Customer does not agree to the revised price, the Company may cancel the Service and no collection will be made. The Company reserves the right to charge a call-out or cancellation fee where a visit has already been made to the premises.

5. Payments and Invoicing

Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. Payment may be made by cash, card, bank transfer, or any other payment method accepted by the Company at the time of Service.

For business or account Customers, invoicing arrangements may be agreed separately. Invoices are payable within the payment terms indicated on the invoice. In the absence of such terms, payment is due within 7 days of the invoice date.

The Company reserves the right to charge interest on late payments at the statutory rate applicable in the United Kingdom, from the due date until the date of actual payment in full, as well as any reasonable costs incurred in enforcing payment.

The Customer shall not be entitled to withhold payment or set off any amount against sums due to the Company unless agreed in writing.

6. Cancellations and Amendments

The Customer may cancel or amend a Booking by giving the Company reasonable notice prior to the scheduled collection time. The Company requests at least 24 hours notice for cancellations or significant amendments.

If the Customer cancels with less than 24 hours notice, or is not present at the agreed time and place for collection (where presence is required), the Company reserves the right to charge a cancellation fee or a call-out fee to cover the costs incurred.

Where the Company is unable to carry out the Service due to factors outside its reasonable control, such as severe weather, traffic incidents, access restrictions, or other unforeseen events, it will aim to rearrange the Booking as soon as reasonably practicable. The Company shall not be liable for any loss or inconvenience arising from such delays or rearrangements.

7. Customer Obligations

The Customer is responsible for ensuring that:

The Waste presented for collection is accurately described at the time of Booking and at the time of collection.

Safe and reasonable access is provided to the Waste and the premises, including any parking or loading requirements, and that any necessary permissions or permits are in place.

No hazardous, prohibited, or controlled substances or items are included in the Waste unless expressly agreed in writing and in compliance with all applicable regulations.

Valuable or personal items are not accidentally included in the Waste. The Company accepts no responsibility for the loss of any item once it has been removed as Waste.

The Customer shall indemnify the Company against any loss, liability, cost, or expense arising from a breach of these obligations.

8. Waste Regulations and Prohibited Items

The Company operates in accordance with applicable UK waste management laws and regulations. Waste collected will be transported and disposed of at licensed facilities and in compliance with environmental legislation.

The Company cannot collect certain items without prior agreement or without following specific procedures. Prohibited or restricted items may include, but are not limited to, asbestos, clinical or medical waste, gas bottles, chemicals, solvents, oils, paint in liquid form, explosives, and certain electrical or hazardous components.

If the Company discovers that prohibited or hazardous Waste has been included without disclosure, it may refuse to remove such items, may amend the price to reflect additional handling and disposal costs, or may require the Customer to arrange for separate specialist collection.

The Customer is responsible for any legal consequences, fines, or penalties resulting from the inclusion of prohibited or misdescribed Waste, where such inclusion is the fault of the Customer.

9. Access, Parking, and Property Conditions

The Customer must ensure that the Company’s vehicle can park legally and safely near the premises for the duration of the collection. Any parking permits, parking fees, or access permissions required are the responsibility of the Customer, unless agreed otherwise.

The Customer shall ensure that access routes to the Waste are safe, clear, and suitable for manual handling. This includes, where relevant, stairways, corridors, gardens, and external areas.

The Company will take reasonable care when carrying out collections but cannot be held liable for damage to driveways, paths, or other surfaces that are not suitable for the weight or nature of the vehicle or the handling of Waste, where the Customer has requested or permitted access over such areas.

10. Liability and Limitations

The Company will exercise reasonable skill and care in providing the Services. However, to the fullest extent permitted by law, the Company’s total liability to the Customer, whether in contract, tort, or otherwise, shall be limited to the price paid or payable for the particular Service giving rise to the claim.

The Company shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of goodwill arising out of or in connection with the Services.

Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other matter in respect of which liability cannot be excluded or restricted under applicable law.

The Customer is responsible for checking, before the Waste is removed, that no items intended to be retained have been placed in the Waste pile. Once items have been loaded and removed, the Company is under no obligation to retrieve them.

11. Delays and Force Majeure

The Company will make reasonable efforts to attend the Customer’s premises at the time and date agreed, but any times quoted are estimates only and are not guaranteed.

The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to extreme weather, traffic disruptions, accidents, breakdowns, strikes, acts of government, or other force majeure events.

12. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Service, they should contact the Company as soon as possible, providing details of the issue and supporting information where available. The Company will investigate and aim to resolve complaints promptly and fairly.

Any dispute arising under or in connection with these Terms and Conditions that cannot be resolved through informal discussions may be referred to appropriate dispute resolution processes or to the courts, in accordance with the governing law and jurisdiction clause below.

13. Data Protection and Privacy

The Company may collect and process personal data relating to the Customer for the purpose of providing the Services, administering Bookings and payments, and for related administrative and legal purposes.

The Company will take reasonable steps to ensure that such personal data is kept secure and processed in accordance with applicable data protection legislation in the United Kingdom. Personal data will not be sold to third parties. It may, however, be shared with service providers or authorities where necessary to deliver the Services, process payments, or comply with legal obligations.

14. Variations to Terms and Conditions

The Company reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of the Booking will apply to that Booking and the corresponding Service.

Updated Terms and Conditions may be provided to the Customer or made available upon request. Continued use of the Services after such changes have been notified will constitute acceptance of the revised Terms and Conditions.

15. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

By making a Booking with Rubbish Removal Holland Park, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
